第１回口頭弁論意見陳述その１－ Daichi Maruyama

国籍法１２条違憲訴訟の第１回口頭弁論が４月２１日に東京地裁で開かれ、２人の原告の子とその父が意見陳述を行いました。以下が原告、Daichi Maruyamaの意見陳述の内容です。

Statement by Daichi Maruyama

Mr. Chief Justice,
This is to tell my opinion about my nationality. I have two brothers and two sisters who are Japanese.They have Japanese Passports but I don’t have a Japanese Passport.
Why am I not Japanese?
I heard that my father submitted all necessary documents to certify my Japanese nationality simultaneously with my brothers and sisters and submitted in accordance with Japanese Embassy’s advice.
I heard that the delay of the submission of the documents was late a few days, which is my father’s mistake not mine.
My father’s mistake is not a mistake because people cause such mistakes by different reasons.
This can’t be a reason of my loss of my Japanese nationality as I have not done any violation of Japanese laws. Why such mistake done by my father resulted in the loss of my Japanese nationality? Why my brothers and sisters received Japanese nationality? I need a fair treatment.
The problem without my Japanese nationality I face now is that each time I come to Japan to meet my grandmother, I need to go to Japan Embassy to receive a visa which takes a long time and lots of documents requested to be submitted and the days I stay in Japan is also very limited which is 15 days while my siblings can stay in Japan as long as they want. I need a fair treatment.

If I receive Japanese nationality I will fully utilize my capacity as a Japanese and will come to Japan to learn how to speak Japanese, and learn its culture. And I will work for Japan internationally.
I believe fair judgment will be given to me and my Japanese Nationality will be recovered.

裁判長、
私の国籍についての私の意見を述べます。 私には2人の兄弟と２人の姉妹がいます。彼らは日本人で日本のパスポートを持っています。私はフィリピン人で日本のパスポートがありません。　どうして私だけ日本人ではないのでしょうか。
私の父が、私の兄弟姉妹と私の日本の国籍を証明するためにすべての必要な文書を日本大使館の助言に従って堤出したと聞いています。 私は、父による文書の提出が数日遅かったことを聞いています。これは私のミスでありません。 人は異なった理由でそのような間違いを引き起こすのではないでしょうか。父の間違いは間違いと呼べるものではありません。 私は何の法律違反も犯していませんので私が日本国籍を失う理由はありません。父の間違いともいえない間違いが、私の日本の国籍喪失の理由となるのでしょうか。同時に書類を提出した私の兄弟姉妹が日本の国籍をなぜもらえたのですか。 公正な処置をお願いいたします。
私が日本国籍を持っていないための現在の問題は、私が祖母に会うために日本に行こうとするたびに日本大使館でビザの申請を行わなければならないことです。ビザの取得のためには大変に時間がかかるだけでなく多くの文書の堤出が要求されます。また私の兄弟が好きなだけ日本にとどまることができるのに、私の滞在は最長でも１5日です。公正な処置をお願いします。

日本国籍が付与された暁には、日本に行き日本語や日本の文化を学んで、私の持つすべての能力や可能性を十全に生かして、日本のために国際的に働こうと思っています。

私は裁判で公平な判断が行われ、、私の日本の国籍が回復されることを信じています。
